Terms and Conditions for MakeStatus

1. Introduction

Welcome to MakeStatus ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the MakeStatus mobile application (the "App").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may:

• Download and install the App on your device
• Use it to create, customize, and share templates for personal use

3. Restrictions

You agree not to:

• Use the App for commercial gain or redistribution
• Modify, reverse-engineer, or decompile the App
• Circumvent any security or technical restrictions
• Copy or reproduce App content except as allowed for personal use

4. User Responsibilities

• You must use the App lawfully and in compliance with all applicable regulations.
• You must be 13 years or older to use the App. Users under 13 must have parental or guardian consent.
• You are responsible for maintaining the security of your device and data.
• Ensure your device meets system requirements for the App's functionality.

5. Intellectual Property

All rights, title, and interest in the MakeStatus App, its code, templates, graphics, and content belong to us.

You are not granted ownership rights by using the App—only a limited license to use it as described in these Terms.

6. User-Generated Content

• You retain ownership of any photos, names, or content you upload or personalize within the App.
• You are solely responsible for ensuring that your content:
  • Does not infringe on third-party rights
  • Is lawful and appropriate for sharing
• We reserve the right to remove or disable content that violates these Terms or applicable laws.

7. Template Usage Rights

You may:

• ✅ Use templates for personal and social use — e.g., WhatsApp, Instagram, Facebook, and personal messaging.
• ❌ Not use templates for commercial, advertising, resale, or mass distribution purposes.

Attribution ("Created with MakeStatus") is appreciated but not required.

8. Updates and Modifications

We may update, modify, or improve the App at any time, including adding or removing features. These updates may occur automatically. Continued use after updates constitutes acceptance of the modified App.

9. Disclaimers

The App and its content are provided on an "as is" and "as available" basis, without warranties of any kind.

We do not guarantee that:

• The App will be error-free or uninterrupted
• Templates will meet your expectations
• The App will be free of malware or harmful components

Use of the App is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any:

• Indirect, incidental, or consequential damages
• Data loss or device malfunction
• Any damages exceeding ₹1,000 INR, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless MakeStatus, its developers, affiliates, and partners from any claims or damages arising from:

• Your misuse of the App
• Your violation of these Terms
• Your infringement of third-party rights

12. Assumption of Risk

You acknowledge that:

• You use the App voluntarily and at your own discretion
• The App's functionality may depend on third-party services or internet connectivity
• You are responsible for safeguarding your device and data

13. Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you:

• Violate these Terms
• Misuse the App
• Engage in unlawful activity

Upon termination, your right to use the App will immediately cease.

14. Effect of Uninstalling

Uninstalling the App removes all locally stored personal data (such as name and photo). Analytics data already collected (anonymous) may remain for analysis purposes as described in the Privacy Policy.

15. Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law principles.

16. Jurisdiction

All disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Salem, India.

17. Dispute Resolution

In the event of a dispute:

• Both parties will first attempt to resolve it amicably via email communication.
• If unresolved within 30 days, it may proceed to arbitration or the courts in Salem, India.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

19. Assignment

You may not assign or transfer these Terms or any rights under them. We may assign these Terms as part of a merger, acquisition, or sale of assets.

20. Force Majeure

We are not liable for delays or failures in performance due to events beyond our reasonable control, including:

• Natural disasters
• Network failures
• Government actions
• Technical issues beyond our control

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MakeStatus regarding your use of the App.

22. Feedback and Suggestions

By submitting feedback, ideas, or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use and incorporate them for improvement of the App, without obligation to you.

23. App Store Compliance

If you downloaded the App from the Google Play Store or another app store:

• You must comply with that platform's terms of service.
• The respective store is not responsible for any issues or claims related to the App.

24. Export Compliance

You agree to use the App in compliance with all applicable export control laws and regulations.
